Section of Department of Administrative Studies and Administrative Law

Organization and Administration of the (not only administrative) Judiciary

(Department of Administrative Studies and Administrative Law)

The theme of the section, anchored in the field of administrative law, provides significant overlaps to constitutional law and allows multidisciplinary and international research of the issues, whose concept and legislation (not only) in the Czech legal environment remains largely unfinished, even after years of laic and expert discussions. There is no doubt that the organization and administration of justice may significantly affect the independence and impartiality of the judiciary as one of the pillars of the rule of law, therefore they deserve appropriate academic and legislative attention. The theme of the section offers a broad range of actual issues. Government of the Czech Republic assumes preparation of Act on judicial council, selecting judges and on assistant judicial personal. The Czech Constitutional Court has recently commented on the appointment of court chairmen and there are also many other issues. The theme of the section has its importance also in the field of administrative justice, where arouses question, which organizational model is to the most appropriate (also from the comparative point of view).
